                                        NCD SERVICE AGREEMENT (the "Agreement" is

​IN CONSIDERATION OF matters described within and obligations set forth in this agreement, the receipt is hereby acknowledged, the Client and the Service Provider, and collectively the "Parties" to this agreeement agrees as follows:​

1. SCOPE OF SERVICES

NCD agrees to provide compliance consulting and administrative services as detailed in the Statement of Work. Any changes to the scope must be agreed upon in writing by both parties. NCD is not responsible for decisions made by any third-party organization, courts, or the recorder's office.

 

2. FEES AND PAYMENT

• Fees: Client shall pay NCD for the services rendered. Fees cannot be waived.

• Payment Terms: Invoices are due upon receipt and are non-refundable.

• Expenses: Client shall reimburse NCD for pre-approved out-of-pocket expenses required to complete the services.

• Clients who pay for services are not entitled to a refund based on the outcome of any case type, program closure/denial, late/expired legal notices/filings, delayed processing, partial services, or approvals.

• NCD charges a one-time $250.00 eviction administrative fee per property or per occurrence. Additional fees that can or may apply include document preparation (Legal Documents, Answers, Complaints, Motions, or Appeals) $175.00-$1500.00, court filing/ Licensed Process Server fees are $100.00, Constable/ Deputy 24-Hour lockout emergency process server court filing fees are $100.00 for same-day service or $50.00 for next-day service. Tenant Occupied Inspection (Fee $75.00 -$250.00 *based on unit size),          Small Claims $500.00, Fresh Credit (Fee $375.00), or                                      Business Development (Fee $750.00)

• Payments are accepted in the form of credit/debit cards (3.5% transaction fee) or Cash App- $PAYNCD  

• Payment plans are accepted; however must be approved by management. The client will be required to pay at least 75% of the balance to be considered. Services will not be provided until the full amount is paid in full.

3. TERM AND TERMINATION

• Term: This Agreement begins on the Effective Date and continues until services are completed or terminated.

• Termination: Either party may terminate this Agreement with [5] days' written notice. If terminated early, Client shall pay for all work performed up to the termination date.

• Client shall notify NCD promptly of any changes in address, telephone number, email address, and/or circumstances, including attorney retainers, legal notices received that might affect services provided.

• NCD may terminate this agreement for fraud claims, disputes of non-refundable charges/fees, or any other cause in its sole discretion.

• Clients MUST keep all scheduled appointments and be prompt, courteous, and prepared. All appointments must be scheduled; no walk-ins allowed.

• NCD is a private agency not funded by any court or funding agency, state/local, or federal. NCD does not guarantee approvals/denials of any service types and does not provide a promise to pay or promissory notes.

• Client waives the right to request a refund if the account is closed by NCD

 

4. CONFIDENTIALITY

Both parties agree to keep all proprietary information, trade secrets, and sensitive compliance data confidential. This obligation extends beyond the termination of this Agreement. The client may authorize individuals and/or companies to make changes unless specified, receive, or release information about services provided by NCD. Anyone not listed, NCD will not release any information about your file. Client authorizes NCD to release information to other parties involved, the court, funding agencies, law enforcement (constable/deputy office), as necessary. NCD may communicate with all parties in your case and review their documents. Information collected from one party in a case will be kept separate and confidential from the other party in the case.  

 

5. COMPLIANCE DISCLAIMER

NCD LLC provides administrative and consulting support. While Company strives for accuracy, Client acknowledges that:

• Final responsibility for legal and regulatory compliance rests solely with the Client.

• NCD is prohibited from providing legal advice and legal representation.

• Client is responsible for providing a driver's license, ID card, and proof of address (lease agreement, ledger, or utility statement)

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, NCD LLC’s total liability for any claims arising out of this Agreement shall not exceed the total amount of fees paid by the Client under this Agreement.

 

7. INDEMNIFICATION

Client agrees to indemnify and hold harmless NCD LLC from any claims, losses, or damages resulting from Client’s breach of this Agreement or any inaccurate information provided by the Client for compliance filings.

 

8. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada. Secretary of State NAC 240a.250 - 775-684-5708

9. ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties and supersedes all prior discussions or proposals. Service completions may take up to 1-30 days to complete, and at times longer, based on the service type.
